  1. By participating in the Prize Draw (the “Prize Draw”), you confirm your acceptance of the following terms and conditions (the "Terms").

  2. The promoter of this Prize Draw is [Geographe Bay Brewing Co. Pty. Ltd T/A Shelter Brewing Co. (169 450 088) whose registered office is at 11 Foreshore Parade BUSSELTON WA 6280 (the “Promoter”).

  3. You will be legally bound by these Terms from the time you submit an entry to the Prize Draw, so please read them carefully before entering.

  4. Any questions, comments or complaints regarding this Prize Draw should be directed to hello@shelterbrewing.com.au.

  5. The Prize Draw is open to individuals who:
    a)    are residents of Australia; and
    b)    are aged eighteen (18) years or over, 

  6. at the time of entry into the Prize Draw and at the time of notification of the Winner (defined below).  Each such individual is an "Entrant" for the purpose of these Terms.

  7. The Prize Draw is not open to employees of the Promoter, their agents or contractors, the Promoter's retailers or to their immediate family members or persons living in the same household, whether or not related, or anyone else otherwise professionally connected with the Prize Draw.

  8. The Promoter reserves the right to verify the eligibility of any Entrant and Winners and their  compliance with these Terms. The Promoter may require such information as it considers reasonably necessary for this purpose.

  9. Internet access, and access to a current email address are required to enter the Prize Draw.

  10. Entry into the Prize Draw is free and no payment is necessary. This excludes the costs paid by an Entrant to access the survey via their internet service provider. These costs are the Entrant’s responsibility and is dependent on the internet service provider used.

HOW TO ENTER

  1. The Prize Draw will open for entries at 3:00PM on 22nd August, 2025 and will close for entries at 12:00PM on 1st October, 2025 (the "Prize Draw Period").

  2. To enter, Entrants must do the following during the Prize Draw Period:
    a)Complete the survey found on the website.  All details on the survey must be filled out accurately, including a valid email address for the Entrant] and
    b) Click "submit" and accept these terms and conditions.

Restrictions on entry

  1. Only entries completed and received by the Promoter during the course of the Prize Draw Period and in accordance with these Terms will be eligible for entry into the Prize Draw.  No responsibility can be accepted for entries that are late, lost or not received for whatever reason.

  2. Only one (1) entry per person is permitted for the Prize Draw.  Multiple entries from the same person and entries generated by automated means will not be accepted. Entrants are not permitted to create multiple email addresses to enter the Prize Draw.

  3. If at any time you wish to withdraw from the Prize Draw, your request should be made in writing to the Promoter at hello@shelterbrewing.com.au

PRIZES

  1. There are 5 (five) prizes to be won ("Prizes").   The Prize includes:

  2. There are 5 (five) festival cards to be won, each to the value of $200.

  3. The following terms apply to the Prize:

  4. Entrants must be 18+. If won, the Prize is redeemable during the BEERHALL festival only. Prize cards will not be valid in venue at Shelter Brewing Co. after the conclusion of the festival.

  5. All Prizes are subject to availability. The Promoter reserves the right to substitute the Prize with an alternative of equal or greater value to the extent permitted by applicable laws.

  6. The Prize must be taken as described and no compensation will be payable if the winner is unable to use the Prize. Any costs incurred in connection with taking or using the Prize (including any tax liabilities) will be the sole responsibility of the winner.

  7. The value of the Prize is accurate and based upon the recommended retail price(s) as at the commencement of the Prize Draw Period. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.

  8. The Prizes are not transferable and cannot be taken, refunded, exchanged or transferred for cash.

SELECTION OF THE WINNER

  1. The winners will be drawn at random from all valid and eligible entries received and verified by the Promoter and/or its agent during the Prize Draw Period (the " Winners").

  2. The selection process and Prize allocation is final and, therefore, no correspondence will be entered into thereafter.

  3. The Winners will be contacted via email following selection.  The Promoter will use the contact details supplied with the entry to contact the Winners and will not be responsible if the contact details supplied to it are incorrect. Please ensure that the email address you provide is valid in order for the Promoter to contact you once you have won.

  4. Entrants who have not won a Prize will not be notified.

  5. If a Winner cannot be contacted or does not claim their Prize within 5 (five) working days of notification after reasonable efforts by the Promoter, that Winner is not eligible for the Prize or has not complied with the Terms, the Promoter reserves the right (at its sole discretion) to withdraw the Prize from that Winner and pick a replacement Winner. No alternative Prize will be awarded to the original Winner.

  6. There is a maximum of one (1) Prize per person.

  7. The Winner may be required to provide proof of eligibility, identity and residence.

  8. The Promoter reserves the right to verify the eligibility of any Entrants, validity of any and all entries and compliance with these Terms.  The Promoter may require such information as it considers reasonably necessary for this purpose and reserves the right to disqualify any Entrant if it reasonably suspects the Entrant has:

(a) provided false or misleading registration information;

(b) tampered with the entry process; or

(c) engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Prize Draw.

PERSONAL INFORMATION

  1. Personal information including the Entrant’s name, email address, telephone number and address will be collected and used for the purpose of conducting this Prize Draw. The Promoter may also disclose this information to third parties, including local regulatory authorities and the Promoter’s agents or third-party service providers, for the purpose of conducting the Prize Draw, or for promotional and marketing purposes (including for direct marketing) (Purpose).

  2. By entering this Prize Draw, the Entrant consents to the use of their personal information for the Purpose, and also that the Promoter may contact them for future marketing and material purposes without payment. Entrants agree that the Promoter may use this information for that purpose and may disclose it to other organisations or persons that may use it for the Purpose.

  3. Entrants may access, change or update their personal information by emailing the Promoter at hello@shelterbrewing.com.au.  A copy of the Promoter’s privacy policy is available at https://shelterbrewing.com.au/pages/privacy-policy. The privacy policy contains information about how individuals may access or correct personal information or make a privacy-related complaint.

  4. The Promoter will not otherwise share an Entrant’s personal details with any third parties except in accordance with the Promoter’s privacy policy, these Terms and as required by law (including to authorities that regulate this Prize Draw and organisations that will need to allocate the prizes to the Winners. 

GENERAL

  1. In all circumstances, the Promoter's decision is final and no correspondence will be entered into.

  2. To the maximum extent permitted by law, the Promoter reserves the right to change these Terms or cancel the Prize Draw at its absolute discretion without liability to any Entrant or other person (subject to compliance with applicable regulations and any directions of a licensing authority).  Any such changes will be effective immediately upon posting to this webpage.

  3. If for any reason this Prize Draw is not capable of running as planned (including where the Prize Draw is impacted by infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures, changes to the availability of the Prize or any other cause beyond the reasonable control of the Promoter), the Promoter reserves the right in its sole discretion and subject to any written direction given by a relevant regulatory authority, to cancel, terminate, modify or suspend the Prize Draw and no compensation will be payable to any Entrants.

  4. The Winners have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoter (including its officers, employees and agents) excludes all liability for (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control and regardless of cause); (b) any inaccessibility or unavailability of any network or wireless service, the Internet and/or any website; (c) any theft, unauthorised access, third-party interference, destruction or alteration of entries; (d) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any damage to any person’s computer(s) or mobile device(s) which may be related to or result from any attempt to participate in the Prize Draw or to download materials in connection with the Prize Draw; (f) any variation in market value of any Prize to that stated in these terms and conditions; and (g) any tax implications.

  5. The Promoter will award the Prize as described in these Terms, but the Promoter accepts no responsibility or liability for the Winner's use of the Prize.

  6. All taxes (excluding goods and service tax), which may be payable as a consequence of receiving the Prize, are the sole responsibility of the Winner(s).

  7. If there is a conflict in these Terms with any other terms whatsoever in respect of the Prize Draw, these conditions will apply.

  8. These Terms do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010 (Cth)), where to do so would contravene that statute.

  9. In the event of a dispute concerning the conduct of the trade promotion or claiming a prize, Entrants must contact the Promoter to attempt to resolve the dispute in good faith.

  10. The laws of the State of Western Australia, Australia shall govern these Terms.  The parties submit to the non-exclusive jurisdiction of the Western Australian courts.
